This was one of my personal value-add projects. The City’s existing-suite legalization process applies when the suite has both a bathroom and cooking facilities, is accessible from outside without passing through the main dwelling unit, and was built before March 12, 2018.

When I went through the process, the City asked me to provide pictures of the existing suite. This is important because the City wants to review what is already there and what safety items still need to be upgraded.

Common items needed for legalization may include:

The City of Calgary has a Secondary Suite Incentive Program that can provide qualifying homeowners with up to $10,000 to help build and register a secondary suite.

However, this does not mean every project automatically gets the full $10,000. The program is based on qualifying safety items that are missing at the time of application and verification.

In my case, I received approximately $6,500 from the City. This is why I tell clients not to assume they will always qualify for the full amount. Depending on what work is already completed and what safety items are still missing, the amount may be lower.

Another important point: work completed before applying to the incentive program may not qualify. The City wants you to apply at the right stage, before completing the eligible safety upgrades.

Important: Apply for the building permit and incentive program at the correct time. If you complete the safety work before applying and before the City verifies the missing items, you may lose some or all of the grant eligibility.

🏦 Why Legal Suites Can Help With Financing

A legal suite can also help with financing. Some lenders, especially in insured lending scenarios, may be able to use more rental income when qualifying a buyer.

CMHC’s rental income guidelines show that for an owner-occupied property with 2 units that is the subject of the mortgage loan insurance application, an up to 100% gross rental income approach may be used.

This does not mean every bank or lender will treat every file the same way. Lender policy, insurer rules, credit strength, down payment, debt ratios, lease details, appraisal rent, and property legality can all matter.

The main lender types buyers may run into are:

  • 🏦 A-lenders / major banks: Usually stricter, but may consider suite income depending on the file and insurer guidelines.
  • 🏠 Monoline lenders: Often work through mortgage brokers and may have competitive insured-lending options.
  • πŸ“„ Credit unions: Can sometimes have different internal policies.
  • πŸ” B-lenders: May be more flexible but usually cost more.
